These Terms of Service govern your use of Petaly. By using the app, website, or related services, you agree to these terms and to our Privacy Policy.
Who Can Use Petaly
Petaly is intended for users who are at least 18 years old. To keep sign-up quick and friction-free, we do not verify your age at registration. By creating an account and using Petaly, you confirm that you are at least 18 years old and that you have the legal capacity to agree to these terms. Confirming your age is your responsibility.
You are responsible for the information you provide and for keeping your device and sign-in methods secure. We may close, suspend, or restrict any account that we reasonably believe belongs to a person under 18, and we may delete the related data subject to the retention rules in our Privacy Policy. If you are a parent or guardian and believe a minor has created an account, contact us at help@petalyapp.com and we will act within a reasonable time.
General Wellness Only
Petaly provides general wellness, cycle tracking, nutrition, and lifestyle guidance. Petaly is not a medical device and does not provide medical advice, diagnosis, treatment, contraception, fertility treatment, emergency help, or professional nutrition care. Always talk to a qualified professional for medical, pregnancy, fertility, nutrition, or safety concerns. Do not use fertile-window estimates as your only method of pregnancy prevention.
Your Account And Content
You own the personal information, logs, photos, prompts, messages, and other content you enter into Petaly. You give Petaly permission to process that content so we can operate, personalize, secure, troubleshoot, and improve the service.
You are responsible for the accuracy of what you share, for the activity that happens under your account, and for keeping your sign-in methods private. If you believe your account has been accessed without your permission, contact us right away.
Community Content
Petaly includes social features such as the Petals feed, private Petal groups, replies, photo posts, support messages, profiles, and phase sharing through QR codes or links. Content you post in these features may be visible to other users of Petaly. Public posts in the Petals feed can be seen by any signed-in user. Posts in private Petal groups can be seen by members of that group. Phase sharing makes your current cycle phase visible to the people you choose to share with for as long as the link remains active.
You keep ownership of the words, photos, and other content you post. By posting, you grant Petaly a worldwide, non-exclusive, royalty-free license to host, store, copy, display, distribute, translate, format, and moderate that content for the purpose of operating, securing, promoting, and improving the service. This license continues for content you posted publicly even after you delete it, only to the extent needed to keep backup copies, comply with law, prevent abuse, or preserve already-distributed copies in other users' histories.
You must have the rights to everything you post. Do not post content you do not own or have permission to share, including other people's photos, private messages, or personal information.
Photos And Other User Media
Petaly lets you upload photos for food scanning, profile pictures, and the Petals community. Every photo, video, or other media you upload is your sole responsibility. By uploading, you confirm that you have the right to share each item, that you have the consent of any identifiable person in it, and that the content does not violate the Community Standards below or any law in your country.
Petaly hosts user media. Petaly does not create, endorse, or vouch for any photo uploaded by a user, and Petaly is not responsible for the content of user-uploaded media. We do not pre-screen every photo before it is uploaded. We may review, blur, remove, restrict, or refuse to host any media at any time, with or without notice, if it violates these terms or if we receive a credible report.
Because age is self-certified at sign-up and not verified by us, every photo you upload is treated as media provided by an adult who has accepted these terms. If we find that a photo was uploaded by, or depicts, a person under 18 in a way that violates these terms, the account will be closed, the content will be removed, and we may report to authorities where the law requires.
Community Standards
Petaly is a wellness space built around respect and care. The following behavior is not allowed anywhere in the community, including the Petals feed, private Petal groups, replies, support messages, profile information, photos, usernames, and any other community surface.
- Harassment, bullying, threats, stalking, or targeted attacks against another person.
- Hate speech, slurs, or content that attacks or dehumanizes people based on identity, gender, sexuality, religion, ethnicity, disability, or similar traits.
- Sexual content involving minors in any form. This results in an immediate permanent ban and may be reported to authorities.
- Nudity, sexually explicit content, or content that sexualizes other users.
- Graphic violence, self-harm encouragement, suicide encouragement, or content that glorifies eating disorders.
- Dangerous medical claims, fake cures, anti-medical-care content, or content that could put someone at health risk.
- Doxxing, sharing private information about another person, impersonation, or pretending to represent Petaly.
- Spam, scams, repeated promotion, link-bait, multi-level marketing, paid solicitation, or unauthorized advertising.
- Sharing or selling another person's content, photos, or posts without permission, including reposting Petaly content outside the app in a way that misleads others.
- Coordinated harassment, brigading, mass reporting, or using multiple accounts to evade limits or moderation.
- Illegal activity, regulated goods, weapons sales, or anything that violates the law in your country.
Reporting And Moderation
Petaly uses a mix of user reports, automated systems, and human review to moderate the community. You can report content or another user from the app. Reports are reviewed in good faith and may be acted on without prior notice to the reported user. We may remove content, hide posts, limit account features, require profile changes, restrict messaging or sharing, suspend accounts, or permanently ban accounts based on what we find.
Decisions are made at our reasonable discretion based on the seriousness of the behavior, prior history, intent, and impact on other users. We are not obligated to act on every report, to investigate every claim, or to share moderation details with anyone other than the affected account.
Suspension And Bans
We may suspend or permanently ban your account if you break these terms, the Community Standards above, or if your behavior puts other users, the service, or third parties at risk. Severe violations, such as content involving minors, credible threats of violence, coordinated harassment, fraud, security attacks, or actions that endanger another user, may result in an immediate permanent ban on the first occurrence and without prior warning.
Less severe issues may receive a warning, a temporary suspension, a removal of specific content, or a feature restriction before escalation. We are not required to follow a fixed strike count.
If your account is banned, you may lose access to your Petaly content, community posts, private groups, sharing relationships, and any unused portion of a Petaly Pro subscription. Refunds for store-purchased subscriptions are handled by Apple App Store or Google Play and are not affected by bans imposed by Petaly. We may take reasonable steps to prevent banned users from creating new accounts, including blocking known identifiers and devices. Attempting to evade a ban is itself a violation of these terms.
Bloom And Predictions
Bloom is Petaly's automated wellness companion for chat, food photo analysis, cycle insights, and related suggestions. Some Bloom features use third-party model gateways, predictions, or automated analysis to provide food estimates, chat replies, cycle insights, and wellness guidance. These results may be incomplete, delayed, or wrong. You are responsible for how you use them.
Subscriptions
Petaly Pro subscriptions are sold through Apple App Store or Google Play. Prices, trial availability, renewal terms, cancellation steps, and taxes are shown by the store before checkout. Subscriptions renew automatically unless cancelled in your store account before the renewal date.
References to unlimited analysis, full feature access, or similar paid-plan benefits are subject to reasonable fair usage limits. We may apply temporary limits, delays, or abuse prevention measures to protect service reliability, prevent automated or excessive use, control third-party model and infrastructure costs, or enforce these terms.
Cancellation And Refunds
You can manage or cancel store subscriptions through your Apple App Store or Google Play account. Deleting your Petaly account does not automatically cancel a store-managed subscription. Refunds, where available, are handled by the store that processed the purchase.
Acceptable Use
In addition to the Community Standards above, you agree not to:
- Misuse the service, bypass rate limits, abuse fair-use limits, or interfere with security.
- Upload unlawful, abusive, private, or non-food images to food scanning features.
- Use Petaly for emergency medical needs or urgent safety situations.
- Use automated systems, bots, scrapers, or other tools to access, copy, or generate activity in Petaly.
- Reverse engineer, decompile, resell, sublicense, or commercially exploit Petaly or its data.
- Use Petaly content, including phase cards, AI replies, or community posts, in a way that misrepresents Petaly, another user, or any third party.
- Create more than one account for the purpose of evading limits, bans, blocks, or moderation.
Third-Party Services
Petaly depends on third-party services for app stores, hosting, authentication, subscriptions, payments, push notifications, storage, third-party model gateways, tracking, analytics, diagnostics, and security. Those services may be unavailable, change, or process information as described in our Privacy Policy.
Availability
We aim to keep Petaly reliable, but the service may change, pause, or become unavailable. Features may be added, removed, limited, or updated at any time.
Termination And Deletion
You may stop using Petaly at any time. You can delete your account in the app or request deletion at petalyapp.com/delete-account. We may suspend or terminate access at any time if these terms are violated, if your behavior puts other users at risk, or if we need to protect the service. Sections that by their nature should survive termination, including content license terms for already-distributed content, disclaimers, limitation of liability, and indemnification, continue to apply after termination.
Indemnification
You agree to defend and hold Petaly and its team harmless from claims, losses, costs, and reasonable legal fees that arise from content you post, behavior in the community, your misuse of the service, or your violation of these terms or the rights of another person. This does not limit any rights you have under consumer protection law that cannot be waived.
Disclaimers
Petaly is provided "as is" and "as available." We do not promise that the app will be error-free, uninterrupted, or perfectly accurate. To the fullest extent allowed by law, Petaly is not responsible for decisions you make based on app content, Bloom output, predictions, reminders, or wellness guidance.
Petaly does not endorse, verify, or take responsibility for content posted by other users in the Petals community, private Petal groups, support messages, or other community surfaces. Community content reflects the views of the people who posted it, not of Petaly. You should not rely on community content for medical, mental health, nutrition, fertility, or safety decisions.
Changes To These Terms
We may update these terms from time to time. If changes are material, we will take reasonable steps to notify you, such as updating the app or this page. Your continued use of Petaly means you accept the updated terms.
